How is an Australian probate resealed in the UK?
Australia is a Country recognised under the UK's Colonial Probate Act, and has a very similar probate process to that in the UK. As a consequence of this, this means that an application can be made in the UK for the Australian grant of probate to be resealed, which requires a specific application before the UK Probate Registry, who will formerly reseal the Australian Grant. We regularly handle reseal applications from States such as Queensland, New South Wales, and Victoria in Australia.
What documents will we need to reseal the Australian Grant?
We will require the following documents :-
- • Death Certificate Certified or Original
- • Original Probate papers issued by the State Court or a Court sealed copy
- • Details of the UK assets to be collected eg. bank account details, share documentation etc
- • Identification of the Executor or Administrator of the Estate to comply with UK ML Rules
