IRELAND PROBATE IN THE UK
Although, Probate in Ireland is very similar to that of the UK, with the Irish High Court issuing a Grant of probate or grant of letters of administration, Ireland is not a recognised country under the Colonial Probate Act, this means that an Irish Grant of probate cannot be Resealed in the UK. Given this, a fresh application in the UK will be required, for the persons appointed by the Irish Courts to make the application, this will typically be the Executor named in the will, or the next of kin ( known as the Administrator ) if the Deceased died Intestate.
Irish probate in the UK: documents we would typically require
We would typically require the following documentation :-
- Original or certified ( by a Notary Public/Solicitor ) Death Certificate
- Original Grant of probate or Letters of Administration issued by the High Court in Ireland, together with the Will, this must be sealed ( eg.carry the stamp ) by the High Court
- Confirmation of the UK assets to be collected eg. UK bank account details, share documentation etc.
- Identification of the Executor or Administrator of the Estate to comply with UK ML Rules – identification must be certified by a Notary Public
